If your name before your e-mail ( "John Smith"> smith@yahoo.com John). Is the (legally) be recognized as a digital signature?

No, a digital signature is a sure way to prove cryptographic algorithms that the author of the e-mail. So it's the same kind of mathematics that says if you have a site that uses the HTTPS protocol (such as a check or a phase in an online store), which showed that the site is to what it purports to be visit.
